Who’s Lying? How to Identify Untruthfulness in
Internal Investigations.
September 24, 2009 | 12:00 pm CT (90
minutes) | 1.2 CEUs
Michael Johnson, Esq. Co-President,
Brightline Learning Division,Global Compliance
In this interactive presentation, attendees play the role of an
investigator, or someone who oversees investigations, and they confront
a variety of complex hypothetical scenarios, many of which are based on
actual cases. Michael Johnson will focus on advanced techniques for
deciding who’s telling the truth and who’s lying, and
properly documenting your findings. One of the biggest issues that
companies deal with is when they have a “he said/she said”
case or another case where there are no eyewitnesses. Often, the
employer feels helpless to reach a conclusion on whether the employee is
guilty and to impose discipline without “smoking gun
evidence.” This conference is designed to give you the tools to
gather all the relevant evidence, reach a conclusion on what happened,
and impose corrective action when necessary. In this interactive
session, you will learn how to:
• Respond if an employee discloses misconduct but requests that
you keep the matter confidential and not investigate
• Decide if the accused should be transferred or suspended during
the investigation
• Respond if the accused brings an attorney, co-worker, or friend
to the investigative interview
• Interview the complainant, the accused, and the witnesses using
the “Funnel Method”
• Determine if a witness is truthful by using advanced
interviewing techniques
• Deal with “he said/she said” allegations
• Decide whether you can always order witnesses to not discuss the
investigation with others
• Choose the appropriate level of discipline, if needed
• Respond to requests to learn what discipline was imposed on the
accused
